1. Acceptance of Terms
By accessing or using the X-Nexus platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and X-Nexus.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. You are responsible for ensuring that your use of the Platform complies with the laws and regulations of your jurisdiction.
3. Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Trading Services
X-Nexus provides access to volatility index trading on synthetic markets. All trades are executed based on real-time market data. The Platform offers Rise/Fall contracts on various volatility indices. Past performance does not guarantee future results. Trading outcomes depend on market conditions and individual decisions.
5. Deposits and Withdrawals
You may fund your account using the payment methods available on the Platform, including cryptocurrency and M-Pesa. Withdrawals are processed according to our standard processing times. X-Nexus reserves the right to request identity verification before processing withdrawals. Minimum deposit and withdrawal amounts may apply.
6. Prohibited Activities
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to manipulate markets or exploit system vulnerabilities; (c) use automated systems or bots not provided by the Platform; (d) create multiple accounts; (e) engage in money laundering or fraudulent activities; (f) interfere with the Platform's operation or security.
7. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are the exclusive property of X-Nexus and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
8. Limitation of Liability
X-Nexus shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. This includes, but is not limited to, trading losses, loss of data, or service interruptions. Our total liability shall not exceed the amount you have deposited on the Platform in the preceding 12 months.
9. Account Termination
X-Nexus reserves the right to suspend or terminate your account at any time if you violate these Terms or engage in prohibited activities. Upon termination, any remaining balance will be returned to you, minus any applicable fees, provided no fraudulent activity is detected.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
